Terms of Service

1. Acceptance of Terms

By accessing or using Twain (the “App”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

3. Accounts and Partner Connections

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. The App allows you to connect with a partner account to share content and location information. You are solely responsible for choosing who you connect with and for any consequences of sharing information with that partner. Content and location data you share through the App is visible to the connected partner.

4. Subscriptions and Billing

The App offers optional subscriptions for “Twain Plus” on a monthly or yearly basis. Subscriptions automatically renew at the end of each billing cycle unless you cancel. You can manage or cancel your subscription through the Apple App Store or Google Play Store, and the applicable platform policies govern refunds. Features available with the App may change over time, and certain functionality may require an active Twain Plus subscription.

5. License to Use the App

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

6. User Content

You retain ownership of the content you create, upload, or share through the App (“User Content”). By using the App, you grant the individual developer operating Twain a worldwide, royalty-free license to host, store, process, transmit, and display your User Content as needed to provide and improve the App. User Content you share within the App may be visible to your connected partner.

7. Location and Safety

The App includes optional location sharing between connected partners. Location sharing is controlled by your device and in-app permissions, and you may disable it at any time. You should only connect and share your location with trusted partners.

8. AI Mediation and No Professional Advice

The App offers an optional “Work it out” feature that uses artificial intelligence to help connected partners talk through a logged issue. When you use this feature, the relevant content—including issues, messages, drafts, your communication preferences, and voice notes you record—is processed by third-party AI providers to generate mediator responses, tone checks, conversation health scores, transcriptions, and summaries.

The mediator is automated and its output is generated by AI. It may be inaccurate, incomplete, biased, or otherwise unsuitable, and it is provided for general, informational purposes only. It is not professional advice and is not a substitute for the judgment of a qualified therapist, counselor, physician, lawyer, or other professional. You are responsible for any decisions you make, and you should not rely on the mediator as your sole basis for any decision affecting your relationship, health, finances, or legal rights.

The feature is not an emergency or crisis service. If you are experiencing abuse, are in danger, or are having thoughts of harming yourself or others, do not use this feature—contact your local emergency services or an appropriate crisis hotline. By using “Work it out,” you acknowledge that your content will be sent to third-party AI providers and that, to the fullest extent permitted by law, the individual developer is not liable for the AI’s output or for any actions taken in reliance on it.

9. Prohibited Conduct

You agree not to misuse the App, including by attempting to interfere with its operation, accessing accounts without authorization, posting unlawful or harmful content, or using the App for any illegal or abusive purpose.

10. Intellectual Property

All rights, title, and interest in and to the App (excluding User Content) are owned by the individual developer. No rights are granted to you except as expressly provided in these Terms.

11. Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Your use of the App is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, the individual developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the App.

13. Termination

The individual developer may suspend or terminate your access to the App at any time for violation of these Terms or to protect the integrity of the service. Upon termination, the rights granted to you under these Terms will cease immediately.

14. Governing Law

These Terms are governed by United States law, without regard to its conflict of laws principles.

15. Changes to Terms

These Terms may be updated from time to time. If changes are made, the revised Terms will be posted in the App or on the associated website, along with the updated effective date. Your continued use of the App after the changes take effect constitutes acceptance of the revised Terms.
